Surrendering the Flags?

What happens when American revolutionary flags are offered for sale from Britain? Well we want them for free. The flags in question are three of which came from Virginia regiments. There is also one Connecticut one. Should we get them for free? Are they spoils of war that the British owner has a right to sell for an estimated 10 million dollars? Or did British General Cornwallis agree that they should not have been taken?

Should they go in a private collection? Or should they be placed in a museum?
